DESTIN — A 19-year-old Destin man has been charged with lewd and lascivious battery on a minor after sexually handling a 14-year-old girl.

Jarvis D. Smith allegedly sent sexually explicit texts to the girl in early March. The texts were discovered by her parents, according to his Okaloosa County Sheriff’s Office arrest report. Her father called Smith and told him she was 14 and that he needed to cease all communication with her, the report said. Her parents also took her phone.

When she got it back in April, she and Smith began communicating again and agreed to meet in a wooded area of Magnolia Plantation late on April 29.

The two began kissing and then began to have intercourse. She pushed him off her and screamed no, according to the report. She then ran away.

Smith contacted her after the encounter, telling her he loved her and wanted to marry her, before the conversation became explicit again.

When a deputy interviewed him, he acknowledged that the girl’s father told him to stay away, but denied knowing that the victim was only 14. He did say she was likely a “freshman or a sophomore,” the report said.

There was physical evidence recovered that supported the girl’s story, the report said.

When authorities seized his phone, Smith asked if he could get in trouble for having photos of other underage girls on it.
