Okaloosa County to draw line in the sand

The next step in Destin beach restoration is figuring how much of the new beach waterfront owners can claim for their own.
Wednesday, Okaloosa County Beach Projects Coordinator Jim Trifilio told the county’s Tourist Development Council that surveyors setting an “erosion control line” in Destin and Okaloosa County are scheduled to begin work Sept. 8.

The line would mark a point along the beach roughly one foot above sea level. The rebuilt beach upland of the ECL is considered part of the property owners’ private beach; sand added south of the line becomes public.
The thought of seeing their beachfront property turned into “gulfview property” has mobilized many beachfront owners to come out against restoration.

A two-year-old lawsuit before the Florida Supreme Court argues that restoration takes away private property rights. Lawsuits filed this month by various condo associations question the quality of the sand that will be used and the legality and fairness of the special Municipal Service Benefits Unit district the county has created to help pay for restoration.

The MSBU will bill beachfront owners based on the recreational and storm-protection benefits their property will see from restoration, but some owners say the formula doesn’t calculate the fees fairly.

TDC attorney Michelle Anchors said Wednesday that the suits have been filed, but the county hasn’t been served with papers yet.
Setting the ECL line will probably generate more controversy. When the Florida Department of Environmental Protection drew up an ECL for the 2007 Crystal Beach restoration, opponents objected that the DEP’s survey used outdated photographs and underestimated how much of the beach should be private.

After the DEP makes its survey, Trifilio said Wednesday, there will be a public hearing followed by a 30-day period for further public comment. The DEP’s hearing officer will then submit a report to the Bureau of Surveying and Mapping for approval.

“This is a long process,” Trifilio said. “We’re trying to get this done, hopefully before holiday season.”

The restoration that has already been done is not holding. Take a look at the beach in South Walton to the east of the Whale's Tail. It has been this way for some time and this is without any big storms.

bb, actually God bats last, so you are screwed. The people who are critically eroded could have already had sand if the powers that be did not have the ulterior motive of taking property rights. You better batten your hind down on the bayou and hope you and your kind do not meet your maker just yet.

to something smells because when you happen to need sand you will need a whole bunch of it with 400 foot wide beach. just remenber MOTHER NATURE BATS LAST. In a 36 hour period a hurricane could take 350 of those feet away. But whats troubling is your group of birds who fly backward will pay an attorney millions to fight the system which held up others areas needing sand in a desperate way you see they had hundreds of beachfront but now the water laps on their building and in harms way. to put a neighbor in harms way is not cool. conclusion we only want cool people living here. together you have a chance divided you end up condemed Hope I explained it for you.

Building 5 of El Matador condo on Okaloosa island has NEVER had any hurricane damage since 1972 and sits several hundred feet back from a 400 feet wide public beach. Why do I and my neighbors each pay 2 and a half times more beach MSBU tax than Destin Pointe owners on private beach on Holiday Isle that needs sand?

George, where were you over the last 14 months when hundreds of your neighbors protested this project? Only a couple Jetty East folks ever showed up. George Warren, owner, and Jerry Stalnaker, paid manager, were there sometimes. There were dozens present from many condos who do not want and do not need this bad sand. We gave alternatives, cited DEP and university reports, and gave technical presentations supporting other options. If you want to protest, get involved. We did.

Destin Point and Jetty East need beach restoration. The rest of Holiday Isle and Destin doesn't need it and doesn't want it. What could possibly be the reason for doing this other than a land grab?
